Terms and Conditions Welcome to ZZJ (hereinafter referred to as the "Platform"). The Platform is wholly owned and operated by ZIZIJA Limited (hereinafter referred to as the "Company"). These Terms apply to all persons who browse, register, and use the Platform. 1. Role of the Platform and Absolute Disclaimer 1.1 Pure Information Directory and Advertising Space: ZZJ is solely a digital classified advertising and information publishing space. The Platform allows independent contractors providing various services (including but not limited to academic tutoring, various hobby classes, sports coaching, nursing services, babysitting and childcare, home and pet services, etc., hereinafter referred to as "Merchants") to publish service information, and allows individuals or organizations seeking services (hereinafter referred to as "Clients") to search and contact them on their own. 1.2 Non-Employment Agency Statement: ZZJ is absolutely not an employment agency as defined under the Employment Ordinance (Cap. 57) of the Laws of Hong Kong. The Platform does not provide any job matching, manual screening, job recommendation, or job placement services. Clients must select Merchants through the search engine on their own. The Platform does not represent, nor does it assist any Merchant or Client in establishing an employment relationship. 1.3 No Involvement in Substantive Transactions: The Platform strictly provides a communication channel. All negotiations, quotations, service agreements, and monetary transactions between Merchants and Clients are handled independently by both parties outside the Platform, and the Company is absolutely not involved in them, nor does it bear any responsibility for any transaction disputes. 1.4 Independent Contractor Statement (New): The Merchant understands and agrees that the relationship between the Merchant and the Company is solely that of an "Advertiser" and an "Information Platform Service Provider". Nothing in these Terms constitutes or should be construed as creating any partnership, joint venture, agency, franchise, employment, or labor-management relationship between the Company and the Merchant or Client. The Merchant is solely responsible for all tax declarations, labor insurance, and legal liabilities arising from the provision of their services. 2. Account Registration Eligibility and Dual Identity Mechanism 2.1 Age and Legality Guarantee (New): You represent and warrant that you are at least 18 years of age and have the full legal capacity to enter into legally binding contracts when registering a ZZJ account. The Merchant further represents and warrants that they hold a valid visa or identity to legally reside and work in the Hong Kong Special Administrative Region, and absolutely have the right to legally provide the services they publish, without breaching any conditions of stay. 2.2 Identity Switching: The Platform allows registered users to freely switch between "Client" and "Merchant" identities within the same account. When users switch to and use a specific identity, it means they agree to be bound by the terms and responsibilities corresponding to that identity. 2.3 Inquiry Limit and Anti-Abuse Mechanism: To protect Merchants from spam messages and maintain system stability, the Platform has a system limit on the number of times a Client can send a "Service Inquiry Form". This limit is purely an IT protection and traffic management mechanism, not a job referral quota. Active users with good reviews may have their inquiry limits automatically increased by the system. 3. Merchant Subscription Plans, Fees, and Credit Card Authorization 3.1 Free and Paid Plans: Merchants can register and publish one basic service for free. If Merchants wish to increase the number of service publications or obtain additional exposure privileges, they can choose to upgrade to a paid subscription plan. 3.2 Credit Card Auto-Renewal: When a Merchant chooses a paid subscription, a valid credit card must be linked. The Merchant agrees and authorizes the Company (through a third-party payment gateway) to automatically deduct the subscription fee from that credit card on a monthly or annual basis. 3.3 Nature of Fees and No Refund Policy: The subscription fee paid by the Merchant is purely an "advertising space and advanced system feature usage fee", and is absolutely not a job introduction fee or commission. The Company does not guarantee that paid Merchants will definitely receive Client inquiries. All deducted subscription fees are non-refundable under any circumstances (including early cancellation of subscription). Aside from the Merchant's advertising subscription fee, the Platform does not have any other online labor transaction features, nor does it charge commissions from any party. 4. Search Ranking, Verification, and Review Mechanism 4.1 Objective Ranking Algorithm: The search ranking on this Platform is influenced by multiple objective data points, including but not limited to: the Merchant's subscription tier, activity level, number of positive reviews received, and whether they are verified. This ranking is generated purely automatically by computers and does not constitute ZZJ's official recommendation of a specific Merchant's service quality or professional qualifications. 4.2 "Verified" Badge: Merchants can voluntarily submit their Hong Kong Identity Card or Business Registration Certificate to obtain a "Verified Merchant" badge. This badge only indicates that the Platform has verified their basic identity, and absolutely does not represent the Platform's endorsement of their professional licenses, conduct, or safety. 4.3 Review Publication Eligibility and Follow-up: To ensure the objectivity and authenticity of the review system, only real users who have previously sent a "Service Inquiry Form" through the Platform, or via a Merchant's exclusive invitation link and passed mobile SMS verification, are eligible to publish reviews. The system will automatically send a notification inviting a review on the 7th day after the Client acquires the contact information. This mechanism is purely to improve the objective database and does not mean the Platform intervenes in the contract between the two parties. All reviews are user-generated content (UGC), and the Company is not responsible for their authenticity. 4.4 Review Guidelines and Platform Removal Rights: Users represent and warrant that all reviews they publish are based on real contact or transaction experiences. It is strictly prohibited to publish any comments containing defamation, insults, false accusations, profanity, privacy violations, or malicious smears from peers. If a Merchant believes they are under attack from false or malicious reviews, they can contact the Platform and provide relevant evidence (e.g., screenshots of chat records) to file a complaint. The Platform reserves the absolute and sole discretion to decide whether to hide, modify, or permanently delete any violating reviews upon receiving a report, without prior notice, and without bearing any legal responsibility for removing or retaining such reviews. 5. Content Publishing and Copyright Authorization 5.1 Merchants warrant that they own the legal copyright or have been authorized to use all text, images, videos, and logos they upload to ZZJ. When you publish content to the Platform, you grant the Company a worldwide, non-exclusive, royalty-free, and transferable license to use, display, reproduce, and modify (e.g., adjusting image sizes) such content on the ZZJ Platform and its associated social media and marketing channels, for the purpose of promoting the Platform and the Merchant's profile. 6. Legal Guarantees, Takedown Rights, and Indemnification 6.1 Legal Compliance: Merchants guarantee that the information they publish contains no misleading elements and shall solely bear the responsibility for any violation of the Trade Descriptions Ordinance (Cap. 362). They also guarantee they possess the statutory qualifications and licenses to legally provide such services in Hong Kong. 6.2 Takedown Rights: If any account is found suspected of fraud, abusing the system, providing false qualifications, or violating these Terms, the Company reserves the right to suspend or permanently terminate that account at any time without prior notice. 6.3 Indemnification Clause (New): Users and Merchants agree that if due to your (i) breach of any provisions of these Terms; (ii) violation of any Hong Kong laws (including but not limited to the Immigration Ordinance, the Trade Descriptions Ordinance, or providing unlicensed services) when using the Platform; or (iii) any claims, lawsuits, or demands raised by any third party resulting from providing or receiving services, you shall bear full indemnification responsibilities to ZZJ and its operators, directors, and employees, and compensate the Company for all losses, damages, and reasonable legal fees suffered as a result. Legal Disclaimer Important Notice: ZZJ is solely an information classified directory. All Clients (parents, individuals, or organizations) must carefully read this disclaimer and assume their own risks before hiring any Merchant. Qualification Verification is the Client's Absolute Responsibility: ZZJ (hereinafter referred to as the "Platform") will not conduct any substantive review of the Merchant's educational background, professional qualifications, statutory licenses (e.g., Registered Nurse Certificate, Sports Coach License), business registration, or sexual offense conviction records. Clients have the absolute responsibility to personally request the Merchant to present and verify relevant statutory proof documents before officially hiring them or allowing them to contact children, the elderly, and pets. Service Quality and Accidental Injury/Death Disclaimer: The Platform does not participate in the service provision process of both parties. Any claims or legal proceedings arising from the Merchant's service performance, negligence, dereliction of duty, or any accidents occurring during the service period (including but not limited to: personal injury, medical malpractice, injury to children or the elderly, lost/injured pets, property loss) are private disputes between the Merchant and the Client. ZZJ and its operators assume no direct, indirect, or joint legal and financial liabilities. Information Authenticity and Review Disclaimer (Updated): All Merchant profiles, images, fee schedules, and user reviews on this Platform are uploaded and published by the users themselves. All reviews and star ratings are purely the users' personal opinions and absolutely do not represent ZZJ's position. The Platform makes no express or implied warranties regarding the accuracy, authenticity, or objectivity of any information or reviews; nor will it bear any legal and compensatory responsibility for any reputational damage or commercial loss caused to Merchants due to false reviews, malicious comments, or potential defamatory remarks appearing on the Platform. Although the Platform has reporting and removal mechanisms, it has no legal obligation to pre-screen any user-generated content. Transaction Risks Borne by Users: After Clients fill out the "Service Inquiry Form" and obtain the Merchant's direct contact information, please handle all communications and monetary transactions carefully. The Platform strongly advises users to beware of online scams. All risks of communications and transactions conducted outside the Platform are entirely borne by the users themselves. Personal Information Collection Statement This Statement is formulated in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong to explain how ZZJ (hereinafter referred to as the "Platform") handles your personal data. 1. Purpose of Data Collection We collect your personal data (including data under dual identities) which will be used for: - Processing your account registration, identity switching, and daily logins; - Displaying the Merchant's public service profile and processing the transmission of the Client's Service Inquiry Form; - Processing automatic credit card transfers for Merchant paid subscriptions (Payment data will be processed and encrypted by a third-party payment gateway; the Platform will not store your full credit card number); - Sending system notifications (including review invitations after 7 days and account status updates); - Executing anti-abuse mechanisms to manage inquiry limits. 2. Public Disclosure of Data When you create a profile as a "Merchant" and make it public, your name/title, service details, and contact information will be publicly displayed for Clients seeking services to view and contact directly. When a Client sends you an inquiry form, the requirements and contact methods filled in by the Client will also be one-way transmitted to you. You agree that the circulation of such information is the core of the classified advertising services provided by the Platform. 3. Handling of Identity Verification Documents If a Merchant submits a Hong Kong Identity Card or Business Registration Certificate for verification purposes, the Platform will only use it for a one-time check. After the check is completed, the relevant image files will be permanently destroyed from our servers without retaining any copies, to maximize the protection of your privacy. 4. Direct Marketing We will not use your data to promote unrelated products without your consent. 5. Right of Access and Correction You have the right to access and correct your personal data.
